When he\u2019d been hired last year as the Coordinator for the Liaison and\nEdification of Administrative Rules (CLEAR) he\u2019d had a thorough introduction to\nthe state health insurance from HR but hadn\u2019t been told his office would be\nnext to the hot water pumping station in the basement of the Hall of Mirrors. But\nthe work was rewarding. He had spent all summer preparing for legislative\nreview of new rules. And the first three weeks of the legislative session were\nbusy but it seemed he had prepared well and the rules review went without much\ndrama. Legislators always had good questions. They had insisted their review of\nrules was important and even got it into the Idaho Constitution. But when the\nsession ended and all those new rules had been dropped by the legislature, he\nwas kind of scratching his head. <\/p>\n\n\n\n<p>\u201cHello, Dennis?\u201d He called his old boss. \u201cWhat are we going\nto do now?\u201d<\/p>\n\n\n\n<p>\u201cHeh, heh.\u201d Dennis chuckled. \u201cStart from scratch.\u201d<\/p>\n\n\n\n<p>\u201cYou mean rewrite <em>all<\/em>\nthe rules?\u201d<\/p>\n\n\n\n<p>\u201cYou\u2019ll have to. All rules, not just the new ones they\nreviewed this session, expire on the first of July unless renewed by the\nlegislature and they didn\u2019t renew them. Start over. Should be fun. I gotta go.\nIf I birdie this I\u2019m three up. Click.\u201d<\/p>\n\n\n\n<p>Darrel called the Governor\u2019s office. \u201cOh, Darrell, I was\nlooking for your number, thanks so much for calling.\u201d Linda was always so\ncheerful. \u201cWe are having a meeting this afternoon and you need to be there.\u201d<\/p>\n\n\n\n<p>\u201cSure. What should I bring?\u201d<\/p>\n\n\n\n<p>\u201cWell, bring your thinking cap and a smile would be good.\u201d<\/p>\n\n\n\n<p>Darrell looked up at the top shelf of his small neat office.\nFour feet of binders held the 8000 pages of fine print of administrative rules.\nWhen the legislature passes a law, the details of just how to follow the law\nare written up into rules and these rules hold the effect of law. They started\non the left with the Accountancy Board and ran south to the Wheat Commission. By\nthe dust on the binders he knew they weren\u2019t up to date. The real rules lived\nin the cloud, on servers, who knows where.<\/p>\n\n\n\n<p>The meeting was called to order and introductions were made.\nDarrell was after the Commissioner on Commissions and before the Director of\nthe Department of Redundancy Department. Darrell had some ideas right away.<\/p>\n\n\n\n<p>Alex, the Chief of Staff, spoke boldly. \u201cI know this is a\nsurprise, but the Governor and I look at this as an opportunity. He has been\nwanting to reduce rules since he signed his second executive order.\u201d<\/p>\n\n\n\n<p>\u201cYou mean the one that told us to cut two rules for every new\none?\u201d asked the Logic Department Director. \u201cIf we follow that order we\u2019ll end\nup with a negative number.\u201d He smiled at his logic.<\/p>\n\n\n\n<p>\u201cThose legislators wanted complete control of the administrative\nrules, and then they go and do this.\u201d Hissed the Chairman on Consistency. <\/p>\n\n\n\n<p>\u201cNow don\u2019t go complaining. This is an opportunity!\u201d\nexclaimed Alex again with a grin. \u201cWe can start over! Our governor wants\ngovernment streamlined and made more efficient and the legislature has given us\nthis gift.\u201d<\/p>\n\n\n\n<p>\u201cI\u2019ll have my secretary just paste in the old rules with a\ndifferent font.\u201d Offered the Chairman of Furniture.<\/p>\n\n\n\n<p>\u201cI was planning on a smaller font so there were less pages.\nAre we counting pages or words?\u201d asked the Director of Measures.<\/p>\n\n\n\n<p>\u201cCan we combine two rules into one? Will that work?\u201d the\nDirector of Efficiency was eager.<\/p>\n\n\n\n<p>\u201cIt all seems pretty silly to me.\u201d Offered the Commissioner\non Common Sense.<\/p>\n\n\n\n<p>The room got quiet except for some murmuring between the\nFinance Director and the Human Resources Commissioner. Darrell thought he\nshould add his part. \u201cWell, you all need to know that the legislature is\nrequired to review all new rules. And since all the rules will be new next\nsession, I think they will be too busy to do much else. It could take them\nmonths.\u201d<\/p>\n\n\n\n<p>Alex grinned.
